    What is 3 Day Eviction Notice?
    The 3 day eviction notice is a notice which has been slapped on you by your landlord as the payment of your rent is late or it has not been paid in full. This notice must be in writing

    How To Prepare The 3 Day Eviction Notice

    The Eviction Process begins by way of a proper Eviction Notice Form and it can also include court appearances along with a trial. This form or Notice to Quit should be individually passed to the tenant about 3 days before the tenant is anticipated to evict. When the eviction date is near the bailiff will explain to the tenant the cause to be evicted and also that you should leave the home immediately. You will also be given 10 mines to pack a few individual items. Soon after this you will have fourteen days to collect the rest of their possessions including their clothes as well as furniture.

    You should first of all be given the Tenant's Termination Form in writing by the landlord. The notice must:
    • Be in writing.
    • It is your right to know the rent was not paid you when it was due.
    • You should know the exact amount of the rent that is due.
    • In the Late Rent Agreement form you should be given three days to vacate (move) or pay the rent. These 3 days does not include the day the day when you were served with the notice, legal holidays and weekends.
    • It should also contain the address, name as well as the telephone number of the landlord.

    How is it delivered?

    In the city of New York, these Legal Documents should be delivered personally to the tenant.  If at the leased premises, the tenant is not available, it should posted in a visible place at the leased premises by taping it to the front door.  It can also be mailed to the tenant.  It however becomes necessary for you to add 5 days each way for mail time.

    Reasons for Evictions

    The New York eviction process will let the landlords to legally evict a tenant for many reasons:

    • Commission of a drug offense
    • Not allowing the landlord to access the property upon reasonable notice (at least 24-hours)
    • Expiry of the lease
    • Non-payment of rent
    • Tenant’s failure to adhere to the health and safety codes

    Based on the reasons, the New York Eviction Notice Form may be 3-days or 30-days.
