Indemnity Insurer’s Subrogation Rights
This involves 3 parties---insurer, insured and tortfeasor (person responsible for the damages). On this kind of subrogation, the insurer takes on the right to sue the tortfeasor for the amount they reimbursed to the insured person.
An example of this is when the farmer (torfeasor) lights a bonfire on his property that spreads damage to a neighbor’s (insured) property. The neighbor claims reimbursement for repairs from the insurance company (insurer) then that company sues the farmer for the amount they reimbursed to the insured neighbor.
